Pope Francis on children and unaccompanied minors on World Day of Migrants and Refugees
On Sunday 14 January 2018 was the 104th World Day of Migrants and Refugees. Pope Francis drew attention to the rights of migrant children, unaccompanied minors and minors separated from their families.

“The ‘International Convention on the Rights of the Child’ provides a universal legal basis for the protection of underage migrants. They must be spared any form of detention related to migratory status, and must be guaranteed regular access to primary and secondary education. (...) Temporary custody or foster programmes should be provided for unaccompanied minors and minors separated from their families. The universal right to a nationality should be recognised and duly certified for all children at birth.”

“La Convention internationale sur les droits de l’enfant offre une base juridique universelle pour la protection des mineurs migrants. Il faut leur éviter toute forme de détention en raison de leur ‘status’ migratoire, tandis qu’on doit leur assurer l’accès régulier à l’instruction primaire et secondaire. (...) Pour les mineurs non accompagnés ou séparés de leur famille, il est important de prévoir des programmes de garde temporaire ou de placement. Dans le respect du droit universel à une nationalité, celle-ci doit être reconnue et opportunément assurée à tous les enfants à la naissance.”

“Das internationale Abkommen zu den Kinderrechten bietet eine rechtliche allgemeine Grundlage für den Schutz der minderjährigen Migranten. Es muss ihnen jede Form der Verwahrung aufgrund ihres ‚Migrantenstatus‘ erspart werden, während der reguläre Zugang zur Primar- und Sekundarbildung gesichert werden muss. (...) Für die Minderjährigen, die ohne Begleitung oder von ihrer Familie getrennt sind, ist es wichtig, Programme zur zeitlichen Obhut oder der Betreuung durch eine Pflegefamilie zu entwerfen. In Achtung des allgemeinen Rechtes auf eine Nationalität muss diese allen Kindern zum Augenblick ihrer Geburt zuerkannt und entsprechend bescheinigt werden.“

“La Convenzione internazionale sui diritti del fanciullo offre una base giuridica universale per la protezione dei minori migranti. Ad essi occorre evitare ogni forma di detenzione in ragione del loro status migratorio, mentre va assicurato l’accesso regolare all’istruzione primaria e secondaria. (...) Per i minori non accompagnati o separati dalla loro famiglia è importante prevedere programmi di custodia temporanea o affidamento. Nel rispetto del diritto universale ad una nazionalità, questa va riconosciuta e opportunamente certificata a tutti i bambini e le bambine al momento della nascita.”

“La Convención internacional sobre los derechos del niño ofrece una base jurídica universal para la protección de los emigrantes menores de edad. Es preciso evitarles cualquier forma de detención en razón de su estatus migratorio y asegurarles el acceso regular a la educación primaria y secundaria. (...) En el caso de los menores no acompañados o separados de su familia es importante prever programas de custodia temporal o de acogida. De acuerdo con el derecho universal a una nacionalidad, todos los niños y niñas la han de tener reconocida y certificada adecuadamente desde el momento del nacimiento.”
